Article 1: General Provisions
The e-commerce website of Arundo Consultancy, a bv with its registered office at Iepersestraat 360, 8800 Roeselare, VAT BE 0830.764.022, RPR Kortrijk, (hereinafter referred to as Gingerclub) offers its customers the opportunity to purchase products from its web store online.
These General Terms and Conditions (“Terms”) apply to every order placed by a visitor to this e-commerce website (“Customer”). When placing an order via the Arundo Consultancy bv web store, the Customer must explicitly accept these Terms, thereby agreeing to the applicability of these Terms, excluding all other conditions. Additional conditions of the Customer are excluded, unless previously, expressly and in writing accepted by Arundo Consultancy bv.
Article 2: Price
All prices are expressed in EURO, always including VAT and all other taxes or duties to be borne by the Customer.
If delivery, reservation, or administrative costs are charged, this will be stated separately.
The price indicated refers exclusively to the articles as described verbally. Accompanying photos are for decorative purposes and may contain elements that are not included in the price.
Article 3: Offer
Despite the fact that the online catalog and the e-commerce website are compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer are not binding on Gingerclub. Gingerclub is only bound by a best-effort obligation concerning the correctness and completeness of the offered information. Gingerclub is in no way liable in the event of manifest material errors, typesetting, or printing errors.
If the Customer has specific questions about, for example, sizes, colors, availability, delivery terms, or delivery methods, we request the Customer to contact our customer service in advance.
The offer is valid as long as stocks last and can be modified or withdrawn at any time by Gingerclub. Gingerclub cannot be held liable for the unavailability of a product. If an offer has a limited validity period or is subject to conditions, this will be explicitly stated in the offer.
Article 4: Online Purchases & Age Verification for the Purchase of Alcoholic Beverages
By ordering online, the buyer declares to gingerclub.be that they are of the legal age of 18 years to purchase and/or consume alcoholic beverages. In accordance with Article 6, paragraph 6 of the Law of January 24, 1977, proof of age may be requested at any time to verify that the customer is over 18 years old. To prevent abuse, you may be asked to prove that you have reached the legal age of 18 after placing your order.
To order, simply click on the shopping cart on the overview page or click the “Order” button on the product page.
When all products are ordered, click on “Cart” in the top right corner where you will get an overview of all ordered products. Here, it is possible to fill in any received discount code.
Then click on “Order these items”. Here you can fill in your address details, choose the delivery method and payment method. Depending on your choice, payment and/or delivery costs will be charged.
The Customer has the choice between the following free payment methods:

Gingerclub is entitled to refuse an order due to a serious shortcoming of the Customer regarding orders involving the Customer.
Article 5: Delivery and Execution of the Agreement
All our shipments are sent with bpost, postNL, or DPD. Each delivery via bpost is subject to a delivery cost depending on the weight of the shipment. This cost is clearly indicated in the checkout procedure control screen.
Items ordered through this web store are delivered in Belgium or other countries of the European Union.
Only packages up to max. 30kg are delivered at the standard proposed transport rates. For heavier packages, we will contact you to propose the most efficient transport method. The cost is always borne by the customer (previously paid transport costs are always deducted).

Finally, it is also possible to pick up your delivery yourself. Pick-up is free during the store’s opening hours. The opening hours can be consulted on the webshop.
Unless otherwise agreed or expressly determined, the goods will be delivered to the Customer’s residence within 14 days of receipt of the order.
Any visible damage and/or qualitative shortcoming of an article or other shortcoming in the delivery must be reported by the Customer to Gingerclub without delay.
The risk of loss or damage passes to the Customer from the moment he (or a third party designated by him, who is not the carrier) has physically acquired the goods. However, the risk already passes to the Customer upon delivery to the carrier if the carrier was instructed by the Customer to transport the goods and this choice was not offered by Gingerclub.
Article 6: Retention of Title
The delivered articles remain the exclusive property of Gingerclub until the moment of full payment by the Customer.
The Customer undertakes, if necessary, to inform third parties of Gingerclub’s retention of title, e.g., to anyone who would seize the items that have not yet been fully paid for.
Article 7: Right of Withdrawal
The provisions of this article only apply to Customers who, in their capacity as consumers, purchase articles online from Gingerclub.
The Customer has the right to withdraw from the agreement within 14 calendar days without giving any reason.
The withdrawal period will expire 14 calendar days after the day on which the Customer or a third party designated by the Customer, who is not the carrier, acquires physical possession of the goods.
To exercise the right of withdrawal, the Customer must inform Arundo Consultancy bv, Iepersestraat 360, 8800 Roeselare, Email info@Gingerclub.be via an unequivocal statement (e.g., in writing by post or email) of his decision to withdraw from the agreement. The Customer may use the attached model withdrawal form for this, but is not obliged to do so.
“The Customer can also electronically fill in and submit the model withdrawal form or any other clearly worded statement to info@Gingerclub.be. If the Customer uses this option, we will promptly send the Customer an acknowledgment of receipt of the withdrawal on a durable medium (e.g., by email).”
To meet the withdrawal deadline, the Customer must send his communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
The Customer must return or hand over the goods to Gingerclub (Arundo Consultancy bv), Iepersestraat 360, 8800 Roeselare without undue delay, but in any case no later than 14 calendar days after the day on which he communicated his decision to withdraw from the agreement to Arundo Consultancy bv. The Customer is on time if he returns the goods before the 14 calendar days period has expired.
The direct costs of returning the goods are borne by the Customer.
If the returned product is diminished in value in any way, Gingerclub reserves the right to hold the Customer liable and claim damages for any depreciation of the goods resulting from the use of the goods by the Customer beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
Only items that are in their original packaging, together with all accessories, instructions, and invoice or purchase receipt can be returned.
If the Customer withdraws from the agreement, Gingerclub (Arundo Consultancy bv) will refund all payments received from the Customer up to that time, including the standard delivery costs, to the Customer within a maximum of 14 calendar days after Gingerclub (Arundo Consultancy bv) has been informed of the Customer’s decision to withdraw from the agreement. In the case of sales contracts, Gingerclub (Arundo Consultancy bv) may withhold the refund until it has received all the goods back, or until the Customer has provided proof of having returned the goods, whichever is the earliest.
Any additional costs resulting from the Customer’s choice of a different method of delivery than the cheapest standard delivery offered by Gingerclub (Arundo Consultancy bv) will not be refunded.
Gingerclub (Arundo Consultancy bv) will refund the Customer using the same payment method that the Customer used for the original transaction unless the Customer has expressly agreed otherwise; in any event, the Customer will not incur any costs for such refund.
Article 8: Warranty
Under the law of 21 September 2004 concerning the protection of consumers when selling consumer goods, the consumer has legal rights. This legal warranty applies from the date of delivery to the first owner. Any commercial warranty does not affect these rights.
To invoke the warranty, the Customer must be able to present proof of purchase. Customers are advised to keep the original packaging of the goods.
For items purchased online and delivered to the Customer’s home, the Customer should contact Gingerclub customer service and return the item at their expense to Gingerclub.
Upon detection of a defect, the Customer must inform Gingerclub as soon as possible. In any case, each defect must be reported within 2 months after it was detected by the Customer. After this period, any right to repair or replacement will lapse.
The (commercial and/or legal) warranty never applies to defects arising from accidents, neglect, falls, use of the item contrary to its intended purpose, failure to comply with the instructions for use or manual, modifications or alterations to the item, rough handling, poor maintenance, or any other abnormal or incorrect use.
Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable delivery, are deemed not to be hidden defects unless the Customer proves otherwise.
Article 9: Customer Service

Article 10: Penalties for Non-Payment
Without prejudice to the exercise of other rights that Gingerclub has, the Customer is, in case of non-payment or late payment, from the date of default by operation of law and without notice, liable to pay interest of 10% per year on the unpaid amount. In addition, the Customer is, by operation of law and without notice, liable to pay a fixed indemnity of 10% on the amount concerned, with a minimum of 25 euros per invoice.
Without prejudice to the foregoing, Gingerclub reserves the right to take back the items that have not been (fully) paid.
Article 11: Privacy
The controller, Gingerclub (Arundo Consultancy bv), respects the Belgian law of 8 December 1992 concerning the protection of privacy in the processing of personal data.
The personal data you provide will only be used for the following purposes: execution of the concluded agreement, processing of the order, sending newsletters, advertising and/or marketing purposes.
You have a legal right to access and possibly correct your personal data. Upon proof of identity (copy of identity card), you can obtain the written communication of your personal data free of charge via a written, dated and signed request to Gingerclub (Arundo Consultancy bv), Iepersestraat 360, 8800 Roeselare, or via email to info@Gingerclub.be. If necessary, you can also ask to correct the data that is incorrect, incomplete, or irrelevant.
In case of the use of data for direct marketing: You can object, free of charge, to the use of your data for direct marketing. To do this, you can always contact Gingerclub (Arundo Consultancy bv), Iepersestraat 360, 8800 Roeselare, or via email to info@Gingerclub.be.
We treat your data as confidential information and will not pass it on, rent or sell it to third parties.
The customer is responsible for keeping his login details confidential and the use of his password. Your password is stored encoded, so Gingerclub has no access to your password.
Gingerclub keeps online (anonymous) visitor statistics to see which pages of the website are visited to what extent.

Article 12: Use of Cookies

Article 13: Impairment of Validity – Non-Waiver
If a provision of these Terms is declared invalid, illegal, or void, this will in no way affect the validity, legality, and applicability of the other provisions.
Failure at any time by Gingerclub to enforce any of the rights listed in these Terms, or to exercise any right thereof, will never be seen as a waiver of such provision and will never affect the validity of these rights.
Article 14: Change of Terms
These Terms are supplemented by other terms explicitly referred to, and the general sales conditions of Gingerclub. In the event of a conflict, these Terms prevail.
Article 15: Proof
The Customer accepts that electronic communications and backups can serve as evidence.
Article 16: Applicable Law – Disputes
Belgian law applies, with the exception of the provisions of private international law concerning applicable law.
The courts of the Consumer’s place of residence are competent in the event of judicial disputes. The Consumer can also contact the ODR platform (http://ec.europa.eu/consumers/odr/).
Annex 1: Model Withdrawal Form
Dear Customer, you should only complete and return this form if you wish to withdraw from the agreement.
